Terms of Service
Last updated: 18 May 2026 Applies to: Konfidence AI web app and website (the "Service")
These Terms of Service ("Terms") govern your use of the Service operated by Innovationera Pty Ltd ("Konfidence", "we", "us", "our"). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) The Service (what it is)
Konfidence AI helps you practice communication and provides feedback based on transcripts and derived coaching signals. The Service is designed for learning and improvement.
The Service does not provide professional, medical, legal, financial, or employment advice. It does not guarantee any specific outcome, including but not limited to: interview offers, scholarship awards, university or college admissions, job placements, examination results, salary outcomes, or career progression. Any decision you make on the basis of feedback the Service provides is your own.
2) Eligibility (16+ minimum)
The Service is available to users aged 16 and over. You may use it only if:
- You are at least 16 years old, and
- You can form a legally binding contract in your jurisdiction (where you are under the legal age of majority, you confirm that a parent or guardian has reviewed these Terms and consents to your use).
You agree to confirm your age accurately at sign-up and to keep your account information up to date.
We do not knowingly accept users under 16. If we learn that an account belongs to a person under 16, we will close it and delete the associated data in accordance with our Privacy Policy.
3) Accounts and security
You are responsible for activities on your account and for maintaining the confidentiality of your sign-in method. You must notify us promptly if you suspect unauthorized access.
You may hold only one personal account. Creating multiple accounts to bypass usage limits, free trials, discount eligibility, or any other entitlement is a material breach of these Terms.
You may not share, sell, lease, or transfer your account credentials. Each account is for use by a single named individual.
We may suspend or terminate accounts to protect users, prevent abuse, comply with law, or address breaches of these Terms.
4) Free access, subscriptions, and billing (Stripe)
Konfidence Plus (web)
- Monthly plan: Konfidence Plus at USD $5/month
- Annual option: Konfidence Plus Annual at USD $40/year
- Free access: eligible users may complete 2 free end-to-end practice sessions before subscribing. Eligibility may vary and may be limited to prevent abuse.
- Payments: processed by Stripe
- Manage billing: via the in-app billing portal
Organisation plans
- Starter at USD $29/month or USD $249/year, with seat and usage limits as set at purchase.
- Growth at USD $79/month or USD $699/year, with seat and usage limits as set at purchase.
- Unlimited by quotation, with custom seat and usage limits agreed in writing.
- A Free organisation tier is also available with limited seats and limited features (interview practice only, restricted monthly usage).
Organisation plans are purchased by an account holder ("Organisation Owner") on behalf of a school, college, university, careers service, or similar institution. The Organisation Owner is responsible for managing seats, inviting students, and ensuring members comply with these Terms (see Section 7).
General billing terms
We may change plans, features, prices, free access, credit allowances, or usage limits at any time. Any price shown at checkout controls the amount charged for that purchase or subscription. Material changes to existing paid subscriptions will be notified in advance where practicable.
Partner discounts and campaign codes
From time to time, we may offer partner-issued or campaign discount codes, including codes distributed through universities, career centers, or other partners. Discount codes:
- may be limited by campaign, institution, email domain, account, redemption count, billing interval, geography, or time period
- may apply only to monthly billing unless we state otherwise
- are non-transferable and may not be sold, shared publicly, automated, or abused
- may be changed, paused, or withdrawn where necessary to prevent abuse or correct errors
Using a discount code does not guarantee ongoing eligibility. If a code is invalid, expired, over its redemption limit, or not eligible for your account or selected plan, checkout may be refused or completed without the discount.
Cancellation
You can cancel at any time via the billing portal. Unless Stripe indicates otherwise, cancellation typically takes effect at the end of the current billing period.
Taxes and currency
Stripe may calculate and collect taxes where required. Your bank may apply currency conversion or other fees.
5) Refund policy (no refunds after charge)
Once a payment is successfully processed ("deducted"), it is final and we do not provide refunds or credits, except where required by law.
For subscriptions, cancel to avoid future charges. Cancelling does not retroactively refund amounts already charged.
No refund is owed where access has been suspended or terminated for breach of these Terms, including breaches of Section 6 (Acceptable use) or Section 7 (Organisation responsibilities).
Nothing in these Terms limits any non-excludable rights you may have under applicable consumer laws (including Australian Consumer Law).
6) Acceptable use and fair-use limits
Acceptable use
You agree not to:
- create multiple accounts, share account credentials, or otherwise circumvent free-tier limits, paid-tier limits, age verification, or geographic restrictions
- use, attempt to use, or assist others in using the Service through automated means (including scripts, bots, agents, headless browsers, scraping, or simulated keyboard or microphone input)
- generate content using prompt injection, model jailbreaking, or other techniques intended to bypass safety controls or extract system prompts or training data
- attempt to reverse engineer, decompile, extract source code, weights, prompts, or other proprietary materials
- interfere with the Service's operation, security, or availability, including denial-of-service activity or excessive request volume
- upload, generate, or share content that is unlawful, defamatory, infringing, harassing, sexually explicit, depicts minors in a sexual context, promotes self-harm, or otherwise violates our Acceptable Use standards
- use the Service for commercial purposes outside the scope of your subscription (for example, using a personal Plus account to deliver paid coaching services to clients)
- include in your recordings any personal information of third parties (such as named teachers, employers, or interviewers) without their consent, beyond what is reasonably necessary for the practice scenario
- impersonate any other person or organisation
Fair-use limits and right to enforce
To protect Service quality, manage costs, and prevent abuse, we apply usage limits on every plan tier. These include, without limitation, daily session limits, monthly session limits, seat counts (for organisations), concurrent processing limits, and recording-length limits.
Specific limits are set per plan and are published in the in-app interface, the relevant plan description at purchase, or on request to info@konfidence.ai. We may update these limits from time to time to reflect product changes, infrastructure costs, or abuse patterns.
If you exceed a fair-use limit, the Service may:
- throttle subsequent requests
- block further sessions until the next reset window
- mark your account as flagged for unusual activity (with reduced concurrent processing)
- suspend or terminate your account
- refuse to process refund or credit requests for sessions blocked by these enforcement actions
We may exercise these rights without prior notice where activity poses a security, abuse, or service-availability risk.
Examples of abuse
Without limiting the above, the following constitute material breach of these Terms and may result in immediate suspension or termination without refund:
- creating multiple accounts to claim free trials repeatedly
- using one account on behalf of multiple individuals
- automating recordings (including playing pre-recorded files, looped audio, or text-to-speech output) to generate sessions
- repeated very-short sessions clearly intended to consume compute without genuine practice intent
- using the Service to generate content for harassment, fraud, or impersonation
- attempting to extract proprietary system prompts, model behaviour rules, or evaluation logic
7) Organisation accounts and educator responsibilities
If you create or administer an organisation account ("Organisation Owner"), you are responsible for:
- accurately representing your institution and your authority to bind it to these Terms
- inviting only students who are 16 or over and who have been informed that their practice transcripts will be processed by Konfidence's Service
- ensuring members of your organisation comply with these Terms
- monitoring use within your organisation's seat and usage caps
- promptly removing members who leave the institution or whose access should otherwise end
The Organisation Owner is jointly and severally liable for any breach of these Terms by members of the organisation. Where breaches by organisation members result in suspension of the organisation's account, no refund is owed for the unused portion of the subscription period.
Organisation plans grant member students access to the Service while their enrollment is active. We do not retain teacher-visible transcripts, audio, or session content for members beyond what is necessary to deliver the agreed Service. See our Privacy Policy for detail on what teachers can and cannot see.
8) Your content and permissions
You retain rights to the content you create. You grant us a limited, worldwide, non-exclusive, royalty-free license to process your content for the purpose of providing and improving the Service (e.g., generating transcripts, computing derived coaching metrics, generating feedback, and producing aggregated, anonymised insights).
You represent and warrant that you have the rights necessary to provide any content you submit and that your content does not violate applicable laws or third-party rights.
We may use aggregated, anonymised, non-identifying data (for example, dimension scores across thousands of sessions) to improve the Service, train evaluation models, and publish industry insights. We will not use your individually identifiable content to train third-party foundation models without your express opt-in consent.
9) AI limitations and user responsibility
The Service uses AI models to generate feedback and suggestions. AI systems can be inaccurate, incomplete, biased, or out of date.
You understand and agree that:
- AI-generated feedback is for informational and educational purposes only
- AI-generated feedback is not professional advice (medical, legal, financial, employment, careers, admissions, or otherwise)
- The Service does not guarantee any specific outcome, including but not limited to interview success, scholarship award, university admission, job offer, salary outcome, examination grade, or career progression
- You are responsible for how you interpret and use the feedback and for decisions you make based on it
- Where the Service provides suggested phrases or sample answers, those are illustrative; using them verbatim in real-world interviews or applications is your choice and your responsibility
The Service is not a substitute for professional coaching, a careers adviser, a teacher, a doctor, a lawyer, or any other qualified human professional.
10) Privacy and data handling
Our Privacy Policy explains how we collect and use personal information. By using the Service, you acknowledge our Privacy Policy.
Recordings are processed to produce a transcript and feedback, then deleted in accordance with our Privacy Policy. Transcripts may be retained while your account is active.
11) Account deletion
You can delete your account:
- In the web app: Profile → Delete account, or
- By contacting info@konfidence.ai
Deletion removes stored transcripts and derived results associated with your account, except where limited retention is required by law (for example, billing transaction records, safeguarding reports retained under the UK Online Safety Act and the Australian Online Safety Act). If you have an active subscription, you should cancel it before deleting your account.
12) Availability and changes
We may update, modify, suspend, or discontinue parts of the Service, and we may change features or pricing over time. We try to minimize disruption but do not guarantee uninterrupted availability.
We are not liable for unavailability caused by events outside our reasonable control, including but not limited to: outages of upstream service providers (such as OpenAI, Google Cloud, Stripe, Resend, or Firebase), internet infrastructure failures, denial-of-service attacks, natural disasters, government action, labour disputes, or pandemic-related restrictions.
13) Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated output.
We do not warrant that the Service will be uninterrupted, error-free, secure, free of viruses, or that defects will be corrected.
14) Limitation of liability
To the maximum extent permitted by law, Konfidence is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, profits, goodwill, revenue, opportunity, or business, arising out of or related to your use of the Service, even if advised of the possibility of such damages.
Where liability cannot be excluded, our total aggregate liability to you for all claims arising out of or related to the Service is limited to the greater of:
- the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or
- USD $100.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including under Australian Consumer Law.
15) Indemnification
You agree to indemnify, defend, and hold harmless Konfidence, its directors, officers, employees, contractors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your breach of these Terms
- your content or your use of the Service
- your violation of any applicable law or third-party right
- where you are an Organisation Owner, any breach of these Terms by members of your organisation
- any claim that content you provided to the Service infringes the rights of a third party
This obligation survives termination of your account and these Terms.
16) Suspension and termination
We may suspend or terminate your account or any portion of the Service:
- at any time, with or without cause, on reasonable notice
- immediately and without notice for material breach of these Terms (including breaches of Sections 6 or 7), suspected fraud, security risk, or where required by law
- where your continued use poses a risk to other users, our service quality, or our infrastructure
On suspension or termination for breach, no refund or credit is owed for the unused portion of any prepaid period.
On termination, the following sections survive: 7 (Indemnification by Organisation Owner), 9 (AI limitations), 13 (Disclaimers), 14 (Limitation of liability), 15 (Indemnification), 17 (Governing law), 18 (Dispute resolution), 19 (Severability and entire agreement), and any provisions which by their nature ought to survive.
17) Governing law
These Terms are governed by the laws of Western Australia, Australia, and you agree to the jurisdiction of the courts located in Western Australia, subject to any non-excludable rights under applicable law.
If you reside in the United Kingdom, the European Union, or another jurisdiction with mandatory consumer protections, you retain the protections of your local consumer law to the extent those protections cannot be waived by contract.
18) Dispute resolution
If you have a complaint, please contact us first at info@konfidence.ai and allow us a reasonable opportunity to resolve the matter informally before commencing any formal proceeding. Most disputes can be resolved this way.
This informal resolution step does not prevent you from exercising any right that cannot be waived under applicable law.
19) Severability and entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
These Terms, together with our Privacy Policy and any plan-specific terms shown at purchase, constitute the entire agreement between you and Konfidence regarding the Service, and supersede any prior agreements on the same subject matter.
Our failure to enforce a provision does not waive our right to enforce it later.
20) Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms and change the effective date. For material changes to paid subscriptions, we will give reasonable advance notice where practicable. Continued use after changes take effect means you accept the updated Terms.
